Maddenin metnine bak\u0131ld\u0131g\u0306\u0131nda; <em>\u201cis\u0327 so\u0308zles\u0327mesiyle veya is\u0327 so\u0308zles\u0327mesinin eki nitelig\u0306indeki personel yo\u0308netmelig\u0306i ve benzeri kaynaklar ya da is\u0327yeri uygulamas\u0131yla olus\u0327an c\u0327al\u0131s\u0327ma kos\u0327ullar\u0131nda esasl\u0131 bir deg\u0306is\u0327iklik\u201d<\/em>ten so\u0308z edildig\u0306i go\u0308ru\u0308lmektedir. Bu bag\u0306lamda, sadece is\u0327 so\u0308zles\u0327mesi ile deg\u0306il, ayn\u0131 zamanda personel yo\u0308netmelig\u0306i veya benzeri kaynaklar veya is\u0327yeri uygulamas\u0131 ile olus\u0327an bir c\u0327al\u0131s\u0327ma kos\u0327ulunda esasl\u0131 deg\u0306is\u0327iklik de bu madde kapsam\u0131ndad\u0131r.<\/p>\n<p style=\"text-align: justify;\">S\u00f6z konusu esasl\u0131 de\u011fi\u015fiklikler ancak durumu i\u015f\u00e7iye <strong>yaz\u0131l\u0131<\/strong> olarak bildirmek suretiyle yap\u0131labilir. Bu \u015fekle uygun olarak yap\u0131lmayan ve i\u015fc\u0327i taraf\u0131ndan <strong>alt\u0131 i\u015f gu\u0308nu\u0308 ic\u0327inde yaz\u0131l\u0131 olarak kabul edilmeyen<\/strong> de\u011fi\u015fiklikler i\u015fc\u0327iyi ba\u011flamaz. \u0130\u015fc\u0327i de\u011fi\u015fiklik o\u0308nerisini bu su\u0308re ic\u0327inde kabul etmezse, i\u015fveren de\u011fi\u015fikli\u011fin gec\u0327erli bir nedene dayand\u0131\u011f\u0131n\u0131 veya fesih ic\u0327in ba\u015fka bir gec\u0327erli nedenin bulundu\u011funu yaz\u0131l\u0131 olarak ac\u0327\u0131klamak ve bildirim su\u0308resine uymak suretiyle i\u015f so\u0308zlemesini feshedebilir. Fakat b\u00f6yle bir durumda i\u015fveren i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6demek zorundad\u0131r. Ayr\u0131ca bildirim s\u00fcresine uymazsa ihbar tazminat\u0131 da \u00f6deyecektir. Bu \u015fekilde tazminatlar\u0131 \u00f6denerek i\u015ften \u00e7\u0131kar\u0131lan i\u015f\u00e7i, feshin ge\u00e7erli bir sebebe dayanmad\u0131\u011f\u0131 iddias\u0131yla i\u015fverene kar\u015f\u0131 i\u015fe iade davas\u0131 a\u00e7abilecektir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu madde 22\u2019nin korumas\u0131ndan bahsedebilmek i\u00e7in \u00f6ncelikle i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 bir de\u011fi\u015fikli\u011fe gidilmesi gerekir. Esasl\u0131 de\u011fi\u015fiklik kavram\u0131nda \u00f6l\u00e7\u00fct olarak i\u015f\u00e7inin durumunun a\u011f\u0131rla\u015fmas\u0131n\u0131 kabul etmek gerekir. \u0130s\u0327c\u0327inin deg\u0306is\u0327iklikten o\u0308nce ve sonraki durumu kars\u0327\u0131las\u0327t\u0131r\u0131larak, is\u0327c\u0327inin menfaati ac\u0327\u0131s\u0131ndan zarar\u0131na olan bir durum saptan\u0131rsa bu deg\u0306is\u0327iklig\u0306in esasl\u0131 deg\u0306is\u0327iklik oldug\u0306u kabul edilmektedir <em>(Nuri \u00c7elik\/Nur\u015fen Caniklio\u011flu\/Talat Canbolat, \u0130\u015f Hukuku Dersleri, Yenilenmi\u015f 29. Bas\u0131, s.433.).<\/em><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f so\u0308zle\u015fmesinin esasl\u0131 unsurlar\u0131 olan i\u015fc\u0327inin i\u015fgo\u0308rme borcu ile i\u015fverenin u\u0308cret o\u0308deme borc\u0327lar\u0131 c\u0327al\u0131\u015fma ko\u015fullar\u0131n\u0131n en o\u0308nemlileridir. Bundan ba\u015fka, i\u015fin nerede ve ne zaman go\u0308ru\u0308lece\u011fi, i\u015f yerindeki c\u0327al\u0131\u015fma su\u0308releri, y\u0131ll\u0131k izin su\u0308releri, u\u0308cret eklentileri, ara dinlenmeleri, evlenme, do\u011fum ve o\u0308lu\u0308m yard\u0131mlar\u0131, o\u0308zel sa\u011fl\u0131k sigortas\u0131 ve bireysel emeklilik sistemi primleri de c\u0327al\u0131\u015fma ko\u015fullar\u0131na dahildir. Vurgulamak gerekir ki, m.22 sadece esasl\u0131 de\u011fi\u015fiklik ic\u0327in getirilmi\u015f bir hu\u0308ku\u0308mdu\u0308r. Yoksa i\u015f ko\u015fullar\u0131nda esasl\u0131 olmayan ve i\u015fverenin yo\u0308netim hakk\u0131 c\u0327erc\u0327evesinde kalan de\u011fi\u015fiklikler (tezga\u0302h de\u011fi\u015fikli\u011fi, oda de\u011fi\u015fikli\u011fi gibi) bu madde kapsam\u0131na girmez.<\/p>\n<p style=\"text-align: justify;\">Esasl\u0131 de\u011fi\u015fiklik hallerinin neler oldu\u011funu tek tek saymak olana\u011f\u0131 yoktur. Bir de\u011fi\u015fikli\u011fin esasl\u0131 olup olmad\u0131\u011f\u0131n\u0131 tespit edebilmek ic\u0327in her somut olay\u0131n o\u0308zelliklerine bakmak gerekir. Bu belirsizli\u011fe ra\u011fmen uygulamada kar\u015f\u0131la\u015f\u0131lan esasl\u0131 de\u011fi\u015fiklik halleri aras\u0131nda genellikle u\u0308cret, i\u015fyeri, i\u015fin niteli\u011fi ve c\u0327al\u0131\u015fma saatlerine ili\u015fkin de\u011fi\u015fiklikler say\u0131labilir.<\/p>\n<ul style=\"text-align: justify;\">\n<li>\u00dc\u0308cret deg\u0306is\u0327iklig\u0306i: I\u0307s\u0327veren is\u0327c\u0327inin u\u0308cretinde ve go\u0308rdu\u0308g\u0306u\u0308 is\u0327in nitelig\u0306inde tek tarafl\u0131 olarak aleyhe deg\u0306is\u0327iklik yapamaz. Yine Yarg\u0131tay\u2019a go\u0308re: u\u0308cretinde bir indirim so\u0308zkonusu olmamakla birlikte, yap\u0131lan is\u0327yeri deg\u0306is\u0327iklig\u0306inde yol u\u0308cretlerini is\u0327c\u0327inin kars\u0327\u0131lamak zorunda b\u0131rak\u0131lmas\u0131 aleyhe esasl\u0131 bir deg\u0306is\u0327iklik olus\u0327turur.<\/li>\n<li>I\u0307s\u0327in nitelig\u0306inde deg\u0306is\u0327iklik: Kural olarak is\u0327 so\u0308zles\u0327mesinde is\u0327c\u0327inin yapacag\u0306\u0131 is\u0327in ac\u0327\u0131kc\u0327a belirlenmis\u0327 olmas\u0131 durumunda, is\u0327veren is\u0327c\u0327iye daha du\u0308s\u0327u\u0308k nitelikte bas\u0327ka is\u0327 veremez. Yarg\u0131tay\u2019a go\u0308re; is\u0327c\u0327inin s\u0327ofo\u0308rlu\u0308k is\u0327inden c\u0327o\u0308p toplama is\u0327ine verilmesi (Y9HD, 02.05.2006, 2005\/34148, 2006\/12415), ato\u0308lyede h\u0131zarc\u0131 olarak c\u0327al\u0131s\u0327an is\u0327c\u0327iden c\u0327at\u0131 tamir is\u0327inin istenmesi (Y9HD, 02.06.1997, 5567\/10579), park ve bahc\u0327eler mu\u0308du\u0308rlu\u0308g\u0306u\u0308nden bulas\u0327\u0131kc\u0327\u0131l\u0131g\u0306a verilmesi (Y9HD, 13.01.1997, 1996\/16268, 1997\/38), daha o\u0308nce gu\u0308ndu\u0308z c\u0327al\u0131s\u0327\u0131rken gece is\u0327ine verilmesi (Y9HD, 03.07.1996, 3709\/15314), epilepsi hastal\u0131g\u0306\u0131 olan bir is\u0327c\u0327inin ins\u0327aat is\u0327ine verilmesi, is\u0327c\u0327inin daha ag\u0306\u0131r ve vardiyal\u0131 bir is\u0327e verilmesi (Y9HD, 21.12.2005, 14209\/40453) esasl\u0131 deg\u0306is\u0327iklik nitelig\u0306indedir.<\/li>\n<li>I\u0307s\u0327yeri deg\u0306is\u0327iklig\u0306i: Taraflar is\u0327 so\u0308zles\u0327mesinde is\u0327c\u0327inin c\u0327al\u0131s\u0327acag\u0306\u0131 is\u0327yerini belirlemis\u0327lerse is\u0327c\u0327inin onay\u0131 olmad\u0131kc\u0327a is\u0327veren is\u0327yerini deg\u0306is\u0327tiremez, onu bas\u0327ka is\u0327yerine nakledemez. Bununla birlikte, Yarg\u0131tay kararlar\u0131nda il ic\u0327inde makul bir uzakl\u0131ktaki bir bas\u0327ka is\u0327yerine naklin esasl\u0131 deg\u0306is\u0327iklik say\u0131lamayacag\u0306\u0131na hu\u0308kmedilmektedir (Y9HD, 30.06.1997, 10230\/13245). I\u0307s\u0327c\u0327inin il s\u0131n\u0131rlar\u0131 d\u0131s\u0327\u0131ndaki bir is\u0327yerine nakledilmek istenmesi esasl\u0131 bir deg\u0306is\u0327iklik say\u0131l\u0131r ve I\u0307s\u0327 Kanunu madde 22 hu\u0308ku\u0308mlerine tabi olur. I\u0307s\u0327c\u0327inin c\u0327al\u0131s\u0327t\u0131g\u0306\u0131 yerin s\u0327ehir merkezinden uzak olmas\u0131 ve servis temin edilememesi esasl\u0131 deg\u0306is\u0327iklik nitelig\u0306inde iken (Y9HD, 02.05.2000, 2384\/6490), ayn\u0131 bina ic\u0327inde bas\u0327ka bir bo\u0308lu\u0308mde go\u0308revlendirme fiziki mekan, sosyal c\u0327evre ve u\u0308cret bak\u0131m\u0131ndan is\u0327c\u0327inin aleyhine sonuc\u0327 dog\u0306urmad\u0131g\u0306\u0131 takdirde c\u0327al\u0131s\u0327ma kos\u0327ullar\u0131nda esasl\u0131 deg\u0306is\u0327iklik olus\u0327turmaz (Y9HD, 08.11.1999,14476\/16682).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u0130\u015fveren i\u015f s\u00f6zle\u015fmesinde bu \u015fekilde bir esasl\u0131 de\u011fi\u015fiklik yapmak isterse bunun i\u00e7in i\u015f\u00e7iye yaz\u0131l\u0131 olarak teklifte bulunmak zorundad\u0131r. Bu teklifin anlam\u0131 \u00f6nceden i\u015f \u015fartlar\u0131nda yap\u0131lacak de\u011fi\u015fiklik i\u00e7in i\u015f\u00e7inin kabul\u00fcn\u00fcn istenilmesidir. Bu anlamda i\u015fverenin yaz\u0131l\u0131 bildirimi, \u201cicap\u201d niteli\u011findedir. Hal b\u00f6yle olunca icapta de\u011fi\u015fikli\u011fe ili\u015fkin t\u00fcm hususlar\u0131n a\u00e7\u0131k bir bi\u00e7imde ifade edilmesi gerekir. \u0130\u015f Kanunu\u2019nda i\u015fverenin de\u011fi\u015fiklik talebinden sonra i\u015f\u00e7inin alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7erisinde i\u015fverene cevap vermesi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu s\u00fcreye i\u015f\u00e7inin d\u00fc\u015f\u00fcnme s\u00fcresi denebilir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f K.m.22 gere\u011fi i\u015fverenin de\u011fi\u015fiklik teklifini i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirmesine kar\u015f\u0131n, i\u015f\u00e7inin alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7erisinde bunu kabul etmemesi halinde s\u00f6z konusu de\u011fi\u015fiklik i\u015f\u00e7iyi ba\u011flamaz. Burada \u00fczerinde durulmas\u0131 gereken noktalardan bir tanesi, i\u015f\u00e7inin a\u00e7\u0131k bir cevap vermeksizin, hi\u00e7 cevap vermemesi ya da susmas\u0131n\u0131n ne anlama gelece\u011fidir? Bilindi\u011fi gibi hukukta kural olarak s\u00fck\u00fbt ikrar say\u0131lmaz, bilakis ret anlam\u0131na gelir. Burada da, i\u015f\u00e7inin de\u011fi\u015fikli\u011fe ili\u015fkin herhangi bir a\u00e7\u0131klamada bulunmamas\u0131, onun reddedildi\u011fi olarak yorumlanmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin reddetti\u011fi de\u011fi\u015fiklikleri i\u015fveren mutlaka uygulamak isterse bu takdirde ne olacakt\u0131r?<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7i kendisi taraf\u0131ndan benimsenmeyen de\u011fi\u015fikliklere uymak zorunda de\u011fildir. \u00d6rne\u011fin \u00fccret veya ikramiye tek tarafl\u0131 olarak eksik \u00f6denmi\u015f ise, mevduata uygulanan en y\u00fcksek faiz ile (\u0130\u015f K.m.34) s\u00f6z konusu fark talep edilebilir. Yine i\u015f\u00e7i arzu ederse i\u015f akdini hakl\u0131 nedenle de sona erdirebilir (\u0130\u015f K.m.24\/II e).<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fverenin i\u015f \u015fartlar\u0131nda yapm\u0131\u015f oldu\u011fu bir de\u011fi\u015fiklik \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n uygulanmamas\u0131 durumunu olu\u015fturarak i\u015f\u00e7iye s\u00f6zle\u015fmeyi hakl\u0131 nedenle sona erdirebilme imkan\u0131 veren bir haldir (\u0130\u015f K.m.24\/II f). <em>\u201c4857 say\u0131l\u0131 \u0130\u015f Kanunun 24\/f maddesinde; i\u015fyerinde \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n a\u011f\u0131rla\u015ft\u0131r\u0131lmas\u0131 halinde i\u015f akdinin i\u015f\u00e7i taraf\u0131ndan derhal feshedilebilece\u011fi d\u00fczenlenmi\u015ftir. \u0130\u015fyerinde 6 ki\u015fi ile \u00e7al\u0131\u015fan davac\u0131n\u0131n tek ba\u015f\u0131na \u00e7al\u0131\u015fmaya zorlanmas\u0131 \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n i\u015fverence a\u011f\u0131rla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6sterir\u201d<\/em> (Yarg.9.HD., 30.03.2006 2005\/28843, 2006\/8026).<\/p>\n<p style=\"text-align: justify;\">Belirtelim ki, \u00e7al\u0131\u015fma \u015fartlar\u0131nda yap\u0131lan de\u011fi\u015fiklik i\u015fverenin y\u00f6netim hakk\u0131 \u00e7er\u00e7evesinde kal\u0131yor veya i\u015fveren taraf\u0131ndan yap\u0131lan de\u011fi\u015fiklik s\u00f6zle\u015fmede yer alan hukuka uygun bir de\u011fi\u015fiklik kayd\u0131na dayan\u0131yorsa, s\u00f6z konusu de\u011fi\u015fikli\u011fe uymayan i\u015f\u00e7inin i\u015f \u015fartlar\u0131n\u0131n uygulanmamas\u0131ndan hareketle yapm\u0131\u015f oldu\u011fu fesih, haks\u0131z fesih olarak nitelendirilecektir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>4857 say\u0131l\u0131 I\u0307s\u0327 Kanunu madde 22\u2019de c\u0327al\u0131s\u0327ma kos\u0327ullar\u0131nda esasl\u0131 deg\u0306is\u0327iklik du\u0308zenlenmis\u0327tir.
