Kanun, Koronavir\u00fcs (\u201cCovid-19\u201d) salg\u0131n\u0131yla m\u00fccadele kapsam\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe konulan tedbirleri d\u00fczenlemesi itibar\u0131yla b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">7226 say\u0131l\u0131 Kanun 30 ayr\u0131 kanunda de\u011fi\u015fiklik yapmaktad\u0131r, bu itibarla \u2018\u2019torba kanun\u2019\u2019 olarak an\u0131lmaktad\u0131r. Ku\u015fkusuz bu Kanun\u2019la yap\u0131lan de\u011fi\u015fikliklerin tamam\u0131 \u00e7ok \u00f6nemlidir ve t\u00fcm\u00fcn\u00fcn de\u011ferlendirilmesi bu \u00e7al\u0131\u015fman\u0131n boyutlar\u0131n\u0131 a\u015fmaktad\u0131r. Burada \u00f6zellikle \u00e7al\u0131\u015fma ya\u015fam\u0131, yarg\u0131lama usul\u00fc, \u00e7ekle \u00f6demeler konusundaki de\u011fi\u015fiklikleri i\u00e7eren 41., 43., 48., 49., Ge\u00e7ici 1. Madde ile Ge\u00e7ici 2. Maddeyle getirilen d\u00fczenlemeler inceleme konusu yap\u0131lm\u0131\u015ft\u0131r:<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>K\u0131sa \u00c7al\u0131\u015fma \u00d6dene\u011fi Hakk\u0131nda D\u00fczenleme (Madde 41)<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">7226 say\u0131l\u0131 Kanun\u2019un 41. maddesiyle 4447 say\u0131l\u0131 \u0130\u015fsizlik Sigortas\u0131 Kanunu\u2019na \u201cGe\u00e7ici 23. Madde\u201d eklenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Bilindi\u011fi \u00fczere k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi, genel ekonomik, sekt\u00f6rel, b\u00f6lgesel kriz veya zorlay\u0131c\u0131 sebeplerle i\u015fyerindeki haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin ge\u00e7ici olarak en az \u00fc\u00e7te bir oran\u0131nda azalt\u0131lmas\u0131 veya s\u00fcreklilik ko\u015fulu aranmaks\u0131z\u0131n i\u015fyerinde faaliyetin tamamen veya k\u0131smen en az d\u00f6rt hafta s\u00fcreyle durdurulmas\u0131 hallerinde, i\u015fyerinde \u00fc\u00e7 ay\u0131 a\u015fmamak \u00fczere sigortal\u0131lara \u00e7al\u0131\u015famad\u0131klar\u0131 d\u00f6nem i\u00e7in gelir deste\u011fi sa\u011flayan bir uygulamad\u0131r.<\/p>\n<p style=\"text-align: justify;\">447 say\u0131l\u0131 Kanun\u2019a eklenen maddeyle, yeni korona vir\u00fcs kaynakl\u0131 zorlay\u0131c\u0131 sebep gerek\u00e7esiyle yap\u0131lan k\u0131sa \u00e7al\u0131\u015fma ba\u015fvurusu ve bu \u00f6denekten faydalanma \u015fartlar\u0131 30\/06\/2020 tarihine kadar ge\u00e7erli olmak \u00fczere yeniden d\u00fczenlenmi\u015ftir. Getirilen bu d\u00fczenlemelerin \u00f6zellikle korona vir\u00fcs salg\u0131n\u0131 y\u00fcz\u00fcnden ekonomik a\u00e7\u0131dan zorlu d\u00f6nemde i\u015f\u00e7iyi koruyucu bir d\u00fczenleme oldu\u011fu s\u00f6ylenebilir. Buna g\u00f6re; k\u0131sa \u00e7al\u0131\u015fman\u0131n ba\u015flang\u0131\u00e7 tarihinden \u00f6nceki \u00e7al\u0131\u015fma s\u00fcresi 120 g\u00fcnden 60 g\u00fcne ve son 3 y\u0131l i\u00e7inde 600 g\u00fcn olan sigortal\u0131 \u00e7al\u0131\u015fma zorunlulu\u011fu 450 g\u00fcne indirilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Bu ko\u015fullar\u0131 ta\u015f\u0131mayanlar i\u00e7inse k\u0131sa \u00e7al\u0131\u015fma s\u00fcresini ge\u00e7memek \u00fczere son i\u015fsizlik \u00f6dene\u011fi hak sahipli\u011finden kalan s\u00fcre kadar k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finden yararlanmaya devam edeceklerdir. (f.2)<\/p>\n<p style=\"text-align: justify;\">K\u0131sa \u00e7al\u0131\u015fma uygulamas\u0131ndan yararlanabilmek i\u00e7in, i\u015f yerinde k\u0131sa \u00e7al\u0131\u015fma uygulanan d\u00f6nemde ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131 davrananlar i\u015f\u00e7iler hari\u00e7 olmak \u00fczere i\u015fveren taraf\u0131ndan hi\u00e7bir i\u015f\u00e7i \u00e7\u0131kar\u0131lmamas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">K\u0131sa \u00e7al\u0131\u015fma ba\u015fvurular\u0131n\u0131n 60 g\u00fcn i\u00e7inde sonu\u00e7land\u0131r\u0131laca\u011f\u0131 da bu madde kapsam\u0131nda h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u00d6te yandan, maddede belirtilen \u00e7al\u0131\u015fma s\u00fcrelerini de\u011fi\u015ftirme ve ba\u015fvuru s\u00fcrelerini uzatmaya Cumhurba\u015fkan\u0131na yetki verilmi\u015ftir. Dolay\u0131s\u0131yla \u00f6n\u00fcm\u00fczdeki s\u00fcre\u00e7te ortaya \u00e7\u0131kan durumun gerekleri dikkate al\u0131narak bu s\u00fcrelerin de\u011fi\u015ftirilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Telafi \u00c7al\u0131\u015fmas\u0131 Hakk\u0131nda D\u00fczenleme (Madde 43)<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 64. maddesinde de\u011fi\u015fiklik yap\u0131larak \u201c<em>Telafi \u00c7al\u0131\u015fmas\u0131<\/em>\u201d bak\u0131m\u0131ndan d\u00fczenlemeye gidilmi\u015ftir. An\u0131lan maddede telafi \u00e7al\u0131\u015fmas\u0131 d\u00fczenlenmi\u015ftir. Telafi \u00e7al\u0131\u015fmas\u0131, zorunlu nedenlerle i\u015fin durmas\u0131, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle i\u015f yerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde at\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine izin verilmesi hallerinde i\u015fveren taraf\u0131ndan yapt\u0131r\u0131lan \u00e7al\u0131\u015fmaya denilmektedir. Eski d\u00fczenlemeye g\u00f6re, \u00e7al\u0131\u015f\u0131lmayan s\u00fcreler i\u00e7in telafi \u00e7al\u0131\u015fmas\u0131 ancak iki ay i\u00e7inde yapt\u0131r\u0131labilmekteydi.<\/p>\n<p style=\"text-align: justify;\">Yasa\u2019n\u0131n 64. maddesinde yap\u0131lan de\u011fi\u015fiklikle telafi \u00e7al\u0131\u015fma s\u00fcresi 2 (iki) aydan 4 (d\u00f6rt) aya \u00e7\u0131kar\u0131lm\u0131\u015f ve Cumhurba\u015fkan\u0131na bu s\u00fcreyi iki kat\u0131na kadar art\u0131rma yetkisi verilmi\u015ftir. Bu yolla i\u015fverenlerin korona vir\u00fcs salg\u0131n\u0131 nedeniyle olu\u015fan olumsuz piyasa ko\u015fullar\u0131nda i\u015fverenlere daha esnek \u00e7al\u0131\u015fma y\u00f6ntemi belirleyebilme imkan\u0131 sa\u011flanmaktad\u0131r.<\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li><strong>Yarg\u0131 S\u00fcrelerinin Durmas\u0131 Hakk\u0131nda D\u00fczenleme (Ge\u00e7ici Madde 1\/1)<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">7226 say\u0131l\u0131 Kanun\u2019un Ge\u00e7ici 1. maddesi, \u00fclkemizde bir s\u00fcreden beri ya\u015fanan Covid-19 salg\u0131n\u0131 y\u00fcz\u00fcnden yarg\u0131 alan\u0131ndaki hak kay\u0131plar\u0131n\u0131n \u00f6nlenmesi amac\u0131yla yarg\u0131lama usul\u00fcndeki s\u00fcreler durdurulmu\u015ftur. Bu d\u00fczenlemeye g\u00f6re;<\/p>\n<p style=\"text-align: justify;\">Dava a\u00e7ma, icra takibi ba\u015flatma, ba\u015fvuru, \u015fik\u00e2yet, itiraz, ihtar, bildirim, ibraz ve zamana\u015f\u0131m\u0131 s\u00fcreleri, hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcreler ve zorunlu idari ba\u015fvuru s\u00fcreleri ile Hukuk, \u0130dari ve Ceza yarg\u0131lamalar\u0131na ili\u015fkin s\u00fcreler, h\u00e2kim taraf\u0131ndan tayin edilen s\u00fcreler ve arabuluculuk ile uzla\u015ft\u0131rma kurumlar\u0131ndaki s\u00fcreler de d\u00e2hil olmak \u00fczere t\u00fcm s\u00fcreler 13.03.2020 (bu tarih d\u00e2hil) tarihinden 30.04.2020 tarihine kadar (bu tarih d\u00e2hil) durdurulmu\u015ftur.<\/p>\n<ul style=\"text-align: justify;\">\n<li><em>Usule ili\u015fkin s\u00fcrelerde durman\u0131n ne anlama geldi\u011fi \u00f6nemlidir. Hukukta s\u00fcrelerin durmas\u0131, durmaya sebep olan olgunun ortadan kalkmas\u0131 \u00fczerine s\u00fcrenin kald\u0131\u011f\u0131 yerden i\u015flemeye devam etmesidir. Yani bu ko\u015fullar alt\u0131nda durma tarihine kadar ge\u00e7en s\u00fcreler, yasal s\u00fcrenin hesab\u0131nda dikkate al\u0131n\u0131r.\u00a0\u00a0<\/em><\/li>\n<li><em>Bu kural ba\u011flam\u0131nda s\u00fcrelerin durmu\u015f olmas\u0131 taraflar i\u00e7in aynen adli tatil s\u00fcrelerinde oldu\u011fu gibi dava a\u00e7maya, \u015fik\u00e2yet yapmaya esasen bir engel te\u015fkil etmez. Bu hususlarda bir yasak yoktur. Ba\u015fka bir ifadeyle taraflar dilerlerse bu gibi i\u015flemleri yapabilirler. Dolay\u0131s\u0131yla \u00f6rne\u011fin bu s\u00fcre i\u00e7inde daval\u0131 taraf\u0131n kendisine tebli\u011f edilen dava dilek\u00e7esine 2 hafta i\u00e7inde cevap dilek\u00e7esi sunmas\u0131na engel yoktur. Ba\u015fka bir ifadeyle \u2018\u2019s\u00fcrelerin durdu\u011fu\u2019\u2019 bu d\u00f6nem i\u00e7inde ilgili taraf a\u00e7\u0131s\u0131ndan gerekli i\u015flemi yap\u0131p yapmama konusunda se\u00e7im hak ve yetkisi vard\u0131r. Neticede korona salg\u0131n\u0131 s\u00fcresinde de hukuki hayat durmam\u0131\u015ft\u0131r; sadece taraflara hak kayb\u0131 ya\u015famamalar\u0131 amac\u0131yla bir imk\u00e2n sa\u011flanm\u0131\u015ft\u0131r.<\/em><\/li>\n<li><em>Kanun, taraflar a\u00e7\u0131s\u0131ndan esasen bir yasal koruma getirmi\u015f; salg\u0131n hastal\u0131k y\u00fcz\u00fcnden insanlar\u0131n haklar\u0131n\u0131n kayb\u0131n\u0131n \u00f6n\u00fcne ge\u00e7meyi ama\u00e7lam\u0131\u015ft\u0131r. Bu itibarla d\u00fczenleme, hak kayb\u0131n\u0131 \u00f6nleyici bir genel d\u00fczenlemedir.<\/em><\/li>\n<li><em>Bu arada dikkat edilmesi gereken \u00f6nemli husus, bu d\u00fczenleme yarg\u0131lama usul\u00fcne ili\u015fkindir. Taraflar\u0131n aralar\u0131ndaki s\u00f6zle\u015fmelerde veya \u00f6zel hukuk ili\u015fkilerinde belirlenmi\u015f olan s\u00fcreler bu d\u00fczenlemenin kapsam\u0131nda de\u011fildir.<\/em><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Nafaka alacaklar\u0131na ili\u015fkin icra takipleri hari\u00e7 olmak \u00fczere \u0130cra \u0130flas hukukundaki s\u00fcreler ve i\u015flemler t\u00fcm icra ve iflas takipleri, taraf ve takip i\u015flemleri, yeni icra ve iflas takip taleplerinin al\u0131nmas\u0131, ihtiyati haciz kararlar\u0131n\u0131n icra ve infaz\u0131na ili\u015fkin i\u015flemler 22\/3\/2020 (bu tarih d\u00e2hil) tarihinden 30.04.2020 tarihine kadar (bu tarih d\u00e2hil) durdurulmu\u015ftur.<\/p>\n<ul style=\"text-align: justify;\">\n<li><em>K\u0131sacas\u0131 icra takibi a\u00e7mak 30.04.2020 tarihine kadar yasak kapsam\u0131ndad\u0131r. Ancak bor\u00e7lular\u0131n mal ka\u00e7\u0131rmalar\u0131n\u0131n nas\u0131l \u00f6n\u00fcne ge\u00e7ilece\u011fi konusuna y\u00f6nelik bir d\u00fczenleme yap\u0131lmam\u0131\u015f ve bir g\u00fcvence \u00f6ng\u00f6r\u00fclmemi\u015ftir.<\/em>\u00a0<em>Kar\u015f\u0131l\u0131ks\u0131z \u00e7ek \u015fikayeti ile taahh\u00fcd\u00fc ihlal su\u00e7una ili\u015fkin \u015fikayet durma s\u00fcresinde yasak kapsam\u0131nda de\u011fildir.<\/em><\/li>\n<li><em>Davalar ve maddi hukuka ili\u015fkin s\u00fcreler 13\/03\/2020 tarihinden itibaren; icra takipleri ve takip hukukuna ili\u015fkin kanunlarda d\u00fczenlenen davalar bak\u0131m\u0131ndan ise s\u00fcreler 22\/03\/2020 tarihinden itibaren durdurulmu\u015ftur<\/em>.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">7226 say\u0131l\u0131 Yasa\u2019n\u0131n ge\u00e7ici 1. maddesinde,\u00a0 yarg\u0131lama usul\u00fc ile \u0130cra ve \u0130flas Hukuku kapsam\u0131ndaki s\u00fcrelerin durdu\u011fu ve yeniden i\u015flemeye ba\u015flayaca\u011f\u0131 tarih, s\u00fcrelerin hesaplanmas\u0131na ili\u015fkin detayl\u0131 d\u00fczenlemeler yer almaktad\u0131r. Al\u0131nan bu \u00f6nlemler kapsam\u0131nda durma s\u00fcresinin ba\u015flad\u0131\u011f\u0131 tarih itibar\u0131yla, bitimine on be\u015f g\u00fcn ve daha az kalm\u0131\u015f olan s\u00fcreler, durma s\u00fcresinin sona erdi\u011fi g\u00fcn\u00fc takip eden g\u00fcnden ba\u015flamak \u00fczere on be\u015f g\u00fcn uzam\u0131\u015f say\u0131lacakt\u0131r. Salg\u0131n\u0131n devam etmesi halinde ise Cumhurba\u015fkan\u0131na, durma s\u00fcresini alt\u0131 ay\u0131 ge\u00e7memek \u00fczere bir kez uzatabilme ve bu d\u00f6neme ili\u015fkin kapsam\u0131 daraltabilme yetkisi tan\u0131nm\u0131\u015ft\u0131r.<\/p>\n<ul style=\"text-align: justify;\">\n<li><em>Bu kapsamda, \u015fayet bu durma bak\u0131m\u0131ndan milat olan 13 Mart 2020 tarihi itibar\u0131yla e\u011fer kalan s\u00fcreniz 15 g\u00fcn veya daha az ise Kanun s\u00fcrelerin yeniden i\u015flemeye ba\u015flad\u0131\u011f\u0131 tarihten itibaren 15 g\u00fcnl\u00fck ek s\u00fcre verilmektedir. \u00d6rne\u011fin dava dilek\u00e7esini 12.03.2020 g\u00fcn\u00fc tebell\u00fc\u011f\u00a0 eden daval\u0131, dava dilek\u00e7esine kar\u015f\u0131 HMK kapsam\u0131nda 2 haftal\u0131k cevap verme s\u00fcreniz bulunmaktad\u0131r. 26.03.2020 de cevap verme s\u00fcreniz sona erecektir. Daval\u0131 olarak, durma s\u00fcresinin ba\u015flang\u0131c\u0131 olan 13 Mart 2020 itibariyle 1 g\u00fcn\u00fc kullanm\u0131\u015f olduk ve kalan 13 g\u00fcn\u00fcm\u00fcz kanun gere\u011fi 15 g\u00fcnden az oldu\u011fu i\u00e7in 30 Nisan\u2019dan sonra 15 May\u0131s\u2019a kadar cevap verebiliriz. 12.03.2020\u2019 de tebli\u011f edilen dava dilek\u00e7esine 15.05.2020 tarihine kadar cevap verebiliriz.<\/em><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Maddede uygulamada ortaya \u00e7\u0131kabilecek olas\u0131 teredd\u00fctlerin \u00f6n\u00fcne ge\u00e7ilmesi i\u00e7in baz\u0131 s\u00fcrelerin bu s\u00fcre\u00e7te i\u015flemeye devam edece\u011fi kural\u0131na yer verilmi\u015ftir. Buna g\u00f6re a\u015fa\u011f\u0131daki s\u00fcreler Ge\u00e7ici 1. maddenin 1. f\u0131kras\u0131 h\u00fckm\u00fcn\u00fcn kapsam\u0131 d\u0131\u015f\u0131nda b\u0131rak\u0131lm\u0131\u015ft\u0131r:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Su\u00e7 ve ceza, kabahat ve idari yapt\u0131r\u0131m ile disiplin hapsi ve tazyik hapsi i\u00e7in kanunlarda d\u00fczenlenen zamana\u015f\u0131m\u0131 s\u00fcreleri,<\/li>\n<li>5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu\u2019nda d\u00fczenlenen koruma tedbirlerine ili\u015fkin s\u00fcreler,<\/li>\n<li>6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nda d\u00fczenlenen ihtiyati tedbiri tamamlayan i\u015flemlere ili\u015fkin s\u00fcreler.<\/li>\n<li><em>Bu noktada dikkat \u00e7ekici olan husus, bu s\u00fcre\u00e7te her ne kadar ihtiyati haciz kararlar\u0131n\u0131n uygulanmas\u0131na imkan\u0131 bulunmamas\u0131na kar\u015f\u0131l\u0131k ihtiyati tedbir kararlar\u0131n\u0131n uygulanmas\u0131nda herhangi bir engelin bulunmad\u0131\u011f\u0131d\u0131r.
