K\u0131dem tazminat\u0131, Yarg\u0131tay\u2019a g\u00f6re \u201ci\u015fverene ait i\u015fyeri ya da i\u015fyerlerinde belli bir s\u00fcre \u00e7al\u0131\u015fm\u0131\u015f olan i\u015f\u00e7inin, i\u015fini kaybetmesi halinde, i\u015finde y\u0131pranmas\u0131 ve yeni bir i\u015f edinmede kar\u015f\u0131la\u015faca\u011f\u0131 g\u00fc\u00e7l\u00fckler ve i\u015fyerine sa\u011flad\u0131\u011f\u0131 katk\u0131 g\u00f6z \u00f6n\u00fcne al\u0131narak, ge\u00e7mi\u015f hizmetlerine kar\u015f\u0131l\u0131k olmak \u00fczere, kanuni esaslar dahilinde i\u015fverence i\u015f\u00e7iye verilen toplu para\u201d olarak tan\u0131mlanan bir tazminat t\u00fcr\u00fcd\u00fcr. K\u0131dem bir ba\u015fka anlat\u0131mla i\u015f\u00e7iye i\u015fyerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre de y\u0131pranmas\u0131n\u0131n ve i\u015fverenine sadakatinin \u00f6d\u00fcl\u00fcd\u00fcr.<\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li>K\u0131dem Tazminat\u0131na Hak Kazanabilmek \u0130\u00e7in Gerekli Olan Ko\u015fullar<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">K\u0131dem Tazminat\u0131n\u0131n elde edilebilmesi i\u00e7in baz\u0131 ko\u015fullar\u0131n sa\u011flanmas\u0131 gerekmektedir. \u015e\u00f6yle ki;<\/p>\n<ol style=\"text-align: justify;\">\n<li>\u0130\u015f S\u00f6zle\u015fmesinin Varl\u0131\u011f\u0131<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Her \u015feyden \u00f6nce, k\u0131dem tazminat\u0131ndan s\u00f6z edebilmemiz i\u00e7in i\u015f\u00e7inin \u0130\u015f Kanunu\u2019na g\u00f6re ge\u00e7erli say\u0131lan bir i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131 gerekir. Y\u00fcr\u00fcrl\u00fckte bulunan 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019na g\u00f6re i\u015f s\u00f6zle\u015fmesi ile bir i\u015fverenin i\u015fyerinde \u00e7al\u0131\u015fan ki\u015fiye i\u015f\u00e7i denilmektedir. \u0130\u015f s\u00f6zle\u015fmesi yaz\u0131l\u0131 veya s\u00f6zl\u00fc olarak yap\u0131lm\u0131\u015f olabilir. Uygulamada \u00e7o\u011funlukla i\u015f\u00e7iler yaz\u0131l\u0131 bir s\u00f6zle\u015fme olmadan fiilen \u00e7al\u0131\u015fmaktad\u0131r. \u0130\u015f Kanunu\u2019nun 14. Maddesi i\u015f ve meslek gruplar\u0131 i\u00e7erisinde yer alan \u015fah\u0131slar\u0131n yapt\u0131\u011f\u0131 \u00e7al\u0131\u015fmay\u0131 i\u015f\u00e7ilik saymad\u0131\u011f\u0131 i\u00e7in, bu ki\u015filer i\u015f\u00e7i olmamalar\u0131 nedeniyle k\u0131dem tazminat\u0131 alamazlar (Ev hizmetlerinde \u00e7al\u0131\u015fanlar, \u00c7\u0131raklar, Sporcular, Rehabilite edilenler vs.)<\/p>\n<ol style=\"text-align: justify;\">\n<li>En Az Tam Bir Y\u0131l \u00c7al\u0131\u015fma \u015eart\u0131;<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in ilk olarak en az 1 y\u0131l s\u00fcreyle ayn\u0131 i\u015fverenin yan\u0131nda \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131 gerekmektedir.\u00a0<strong>Bir y\u0131ldan az s\u00fcre ile \u00e7al\u0131\u015ft\u0131ysa k\u0131dem tazminat\u0131ndan s\u00f6z edilemez.<\/strong>\u00a0Bir y\u0131ll\u0131k s\u00fcreye tatil vs. dahil iken, grev\/lokavt nedeniyle s\u00f6zle\u015fmenin ask\u0131da oldu\u011fu s\u00fcreler dahil edilmemektedir. K\u0131dem tazminat\u0131n\u0131 hak edebilmek i\u00e7in \u00e7al\u0131\u015fmak gereken asgari s\u00fcre s\u00fcrekli de\u011fi\u015fmi\u015ftir; kanunumuza girdi\u011finde toplamda \u00e7al\u0131\u015f\u0131lm\u0131\u015f olmas\u0131 gereken asgari s\u00fcre 5 y\u0131l iken, sonralar\u0131 3 y\u0131la ve \u015fu anki duruma g\u00f6re 1 y\u0131la kadar indirilmi\u015ftir. \u0130\u015f\u00e7i ayn\u0131 i\u015fverenin farkl\u0131 i\u015fyerlerinde, hatta farkl\u0131 \u015firketlerinde \u00e7al\u0131\u015fsa bile 1 y\u0131ll\u0131k s\u00fcrenin hesaplanmas\u0131nda t\u00fcm bu \u00e7al\u0131\u015fmalar g\u00f6z \u00f6n\u00fcnde bulundurulur.<br \/>\nAncak, bu durumun aksi s\u00f6z konusu oldu\u011funda, yani i\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanamam\u0131\u015f olmas\u0131na ra\u011fmen i\u015fverenin, i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6demesine \u0130\u015f Yasas\u0131na g\u00f6re engel bir durum yoktur. \u0130\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in en az bir y\u0131ll\u0131k s\u00fcrelik \u00e7al\u0131\u015fmas\u0131n\u0131 ayn\u0131 i\u015fverene ait i\u015fyerlerinde ge\u00e7irmi\u015f olmas\u0131 gerekmektedir. \u00c7al\u0131\u015fma s\u00fcresinin ayn\u0131 holding b\u00fcnyesinde farkl\u0131 i\u015fyerlerinde ger\u00e7ekle\u015ftirmesi durumunda da k\u0131dem tazminat\u0131 a\u00e7\u0131s\u0131ndan herhangi bir de\u011fi\u015fiklik olmayacak i\u015f\u00e7i 1 y\u0131ll\u0131k s\u00fcreyi doldurunca ve a\u015fa\u011f\u0131da belirtti\u011fimiz \u015fartlar olu\u015funca k\u0131dem tazminat\u0131na hak kazanacakt\u0131r. Yarg\u0131tay\u2019\u0131n yakla\u015f\u0131m\u0131 da bu y\u00f6ndedir. Nitekim, bu yakla\u015f\u0131m; \u201c\u015firketler aras\u0131nda organik ba\u011fdan s\u00f6z edilerek k\u0131dem tazminat\u0131 miktar\u0131n\u0131 hesaplama\u201d y\u00f6n\u00fcndedir.<\/p>\n<ol style=\"text-align: justify;\">\n<li>\u0130\u015f Akdinin Tazminat\u0131 Hak Edecek \u015eekilde Sona Ermi\u015f Olmas\u0131<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi her durumda i\u015f\u00e7i k\u0131dem tazminat\u0131 talep edemez. \u0130\u015f\u00e7inin k\u0131dem tazminat\u0131na hangi durumlarda hak kazanaca\u011f\u0131 kanunda a\u00e7\u0131k\u00e7a belirtilmi\u015ftir. K\u0131dem tazminat\u0131n\u0131n \u00f6denmesi i\u00e7in i\u015f s\u00fcresinin belirsiz ya da belirli olmas\u0131n\u0131n bir \u00f6nemi yoktur. Ancak belirli s\u00fcreli i\u015f s\u00f6zle\u015fmesi, s\u00fcrenin dolmas\u0131 ile sona ererse i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamaz.<br \/>\nBelirli s\u00fcreli i\u015f s\u00f6zle\u015fmesi, belli i\u015flerde veya belli bir i\u015fin tamamlanmas\u0131 i\u00e7in i\u015fveren ile i\u015f\u00e7i aras\u0131nda yaz\u0131l\u0131 olarak yap\u0131lan s\u00f6zle\u015fmelerdir. Belirli i\u015f s\u00f6zle\u015fmeleri i\u015fin bitimi ile veya s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan \u015fart\u0131n ger\u00e7ekle\u015fmesiyle kendili\u011finden sona erer, kendili\u011finden sona eren bu i\u015f s\u00f6zle\u015fmelerinde k\u0131dem tazminat\u0131na hak kazan\u0131lamaz.<strong>\u00a0Ancak, belirli s\u00fcreli i\u015f s\u00f6zle\u015fmesi s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan i\u015fin bitiminden \u00f6nce i\u015fveren taraf\u0131ndan haks\u0131z nedenlerle veya i\u015f\u00e7i taraf\u0131ndan hakl\u0131 nedenlerle feshedilirse i\u015f\u00e7i k\u0131dem tazminat\u0131 almaya hak kazan\u0131r.<\/strong><br \/>\n\u0130\u015f\u00e7inin \u0130\u015f Kanunu 24. maddede belirtilen sebeplerden birine dayanarak i\u015f s\u00f6zle\u015fmesini bildirimsiz feshetmesi halinde i\u015f\u00e7i, k\u0131dem tazminat\u0131 almaya hak kazan\u0131r.<br \/>\nAncak i\u015fveren \u0130\u015f Kanunu 25. madde uyar\u0131nca i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshederse i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamaz.<\/p>\n<p style=\"text-align: justify;\">Bu noktada belirtmek gerekir ki\u00a0<strong>i\u015f\u00e7inin k\u0131dem tazminat\u0131 alabilmesi i\u00e7i ge\u00e7mesi gereken bir y\u0131ll\u0131k s\u00fcrenin ba\u015flang\u0131c\u0131 i\u015f s\u00f6zle\u015fmesinin yap\u0131ld\u0131\u011f\u0131 tarih de\u011fil, i\u015f\u00e7inin fiilen i\u015fe ba\u015flad\u0131\u011f\u0131 tarihtir.<\/strong>\u00a0Belirtilen s\u00fcre i\u00e7inde ge\u00e7en deneme s\u00fcresi, i\u015f\u00e7inin izni, tatil, dinlenme gibi nedenlerle \u00e7al\u0131\u015fmad\u0131\u011f\u0131 g\u00fcnler de k\u0131demden say\u0131lmal\u0131d\u0131r. Ancak Yarg\u0131tay tutuklulukta ge\u00e7en s\u00fcre ile \u00fccretsiz izinleri i\u015f\u00e7inin k\u0131demine dahil etmemektedir.<\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li>K\u0131dem Tazminat\u0131nda Dikkat Edilmesi Gereken Hususlar<\/li>\n<li>\u0130\u015f\u00e7i i\u015fi kendi iste\u011fi ile, hakl\u0131 bir neden olmaks\u0131z\u0131n, b\u0131rak\u0131yorsa k\u0131dem tazminat\u0131 \u00f6denmez.<br \/>\n2. \u0130\u015f\u00e7i askere gitmek, emekli olmak i\u00e7in i\u015fi b\u0131rak\u0131yorsa k\u0131dem tazminat\u0131 \u00f6denir.<br \/>\n3. Kad\u0131n i\u015f\u00e7iler evlendikleri tarihten itibaren 1 y\u0131l i\u00e7erisinde i\u015fi kendi istekleri ile b\u0131raksalar dahi k\u0131dem tazminat\u0131 hak ederler.<br \/>\n4. \u0130\u015f\u00e7inin \u00f6l\u00fcm\u00fc halinde k\u0131dem tazminat\u0131 miras\u00e7\u0131lar\u0131na da \u00f6denebilir.<br \/>\n5. \u0130\u015f\u00e7i ve i\u015fverenin anla\u015fmas\u0131 suretiyle s\u00f6zle\u015fme sona erdiriliyorsa k\u0131dem tazminat\u0131 s\u00f6z konusu de\u011fildir.<br \/>\n6. Belirli s\u00fcreli i\u015f s\u00f6zle\u015fmelerinde s\u00f6zle\u015fmenin s\u00fcresinin sona ermesi halinde k\u0131dem tazminat\u0131 \u00f6denmez ancak bu t\u00fcr s\u00f6zle\u015fmelerde i\u015f\u00e7i haks\u0131z yere i\u015ften \u00e7\u0131kar\u0131l\u0131r ve yukar\u0131da belirtti\u011fimiz \u015fartlar olu\u015fursa k\u0131dem tazminat\u0131na hak kazan\u0131r.<br \/>\n7. \u0130\u015f\u00e7i ayn\u0131 i\u015fverene ba\u011fl\u0131 olarak de\u011fi\u015fik i\u015f yerlerinde \u00e7al\u0131\u015fmas\u0131 durumunda k\u0131dem tazminat\u0131 s\u00fcresi hesaplan\u0131rken bu s\u00fcreler toplanarak hesaplan\u0131r.<br \/>\n8. \u015eayet i\u015f\u00e7i ayn\u0131 i\u015fverene ba\u011fl\u0131 olarak farkl\u0131 i\u015f yerlerinde arakl\u0131kl\u0131 olarak \u00e7al\u0131\u015f\u0131l\u0131yor ise s\u00fcreler ba\u011f\u0131ms\u0131z olarak dikkate al\u0131nacakt\u0131r.<br \/>\n9. \u0130\u015fyerinin devri halinde i\u015f\u00e7ilerin k\u0131dem tazminat\u0131ndan eski ve yeni i\u015fveren m\u00fcteselsilen sorumludurlar.<br \/>\n10. \u00c7\u0131rakl\u0131kta ge\u00e7en s\u00fcre veya yasal \u00e7al\u0131\u015fma ya\u015f\u0131n\u0131n alt\u0131nda \u00e7al\u0131\u015f\u0131lan zamanda ge\u00e7en s\u00fcre k\u0131dem tazminat\u0131n\u0131n hesaplanmas\u0131nda dikkate al\u0131nmaz.<br \/>\n11. K\u0131dem tazminat\u0131 nakden \u00f6denmelidir ancak i\u015f\u00e7iyle anla\u015f\u0131lmas\u0131 halinde k\u0131dem tazminat\u0131 taksitler halinde \u00f6denebilir. \u0130\u015f\u00e7inin grev ve lokavtta ge\u00e7en s\u00fcreleri k\u0131dem tazminat\u0131n\u0131n hesab\u0131nda dikkate al\u0131nmaz ayr\u0131ca toplu i\u015f s\u00f6zle\u015fmelerine bunun aksine h\u00fck\u00fcm konulamaz.<\/li>\n<li>K\u0131dem Tazminat\u0131 Zamana\u015f\u0131m\u0131 S\u00fcresi Ne Kadard\u0131r?<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">K\u0131dem tazminat\u0131yla ilgili ba\u015fvurularda 12\/10\/2017 tarihinden \u00f6nce zamana\u015f\u0131m\u0131 s\u00fcreleri 10 y\u0131l ancak bu tarihten sonra uygulanacak zamana\u015f\u0131m\u0131 s\u00fcreleri 5 y\u0131ld\u0131r.<\/p>\n<ol style=\"text-align: justify;\" start=\"5\">\n<li>K\u0131dem Tazminat\u0131nda Arabuluculuk<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">7036 say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu ile 01.01.2018 tarihinden itibaren arabulucuya ba\u015fvuru zorunlulu\u011fu getirilmi\u015ftir. \u0130\u015f\u00e7i ile i\u015fveren aralar\u0131ndaki i\u015f uyu\u015fmazl\u0131klar\u0131ndan kaynaklanan konularda, dava a\u00e7madan \u00f6nce zorunlu olarak arabulucuya ba\u015fvuru yapmalar\u0131 gerekmektedir. Arabuluculuk m\u00fczakeresinde taraflar aras\u0131nda uzla\u015fma sa\u011flanamad\u0131 ise arabulucunun haz\u0131rlad\u0131\u011f\u0131 anla\u015f\u0131lamad\u0131\u011f\u0131na ili\u015fkin tutana\u011f\u0131n asl\u0131n\u0131 ya da onaylanm\u0131\u015f bir \u00f6rne\u011fini dava dilek\u00e7esine eklenerek \u0130\u015f Mahkemesinde dava a\u00e7\u0131lmal\u0131d\u0131r. Bu tutanak eklenmedi\u011fi takdirde \u0130\u015f Mahkemesi davac\u0131ya bir haftal\u0131k kesin s\u00fcre i\u00e7inde bu tutana\u011f\u0131n mahkemeye ibraz\u0131n\u0131 aksi takdirde davan\u0131n reddedilece\u011fini ihtar eder.<\/p>\n<ol style=\"text-align: justify;\" start=\"6\">\n<li>G\u00f6revli Ve Yetkili Mahkeme<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015f mahkemelerinde a\u00e7\u0131lacak davalarda yetkili mahkeme, daval\u0131 ger\u00e7ek veya t\u00fczel ki\u015finin davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihteki yerle\u015fim yeri mahkemesi ile i\u015fin veya i\u015flemin yap\u0131ld\u0131\u011f\u0131 yer mahkemesidir. Birden fazla daval\u0131 var ise bunlardan birinin yerle\u015fim yeri mahkemesi de dava a\u00e7\u0131lmas\u0131 hususunda yetkilidir.<\/p>\n<ol style=\"text-align: justify;\" start=\"7\">\n<li>K\u0131dem Tazminat\u0131 Nas\u0131l Hesaplan\u0131r?<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">K\u0131dem tazminat\u0131na hak kazanm\u0131\u015f bir i\u015f\u00e7i, \u00e7al\u0131\u015ft\u0131\u011f\u0131 kurumdaki her tam y\u0131l i\u00e7in 30 g\u00fcnl\u00fck br\u00fct \u00fccret tutar\u0131nda k\u0131dem tazminat\u0131 \u00f6denmelidir. Bir y\u0131ldan artan s\u00fcreler var ise bir y\u0131la oranlanarak hesaplamaya dahil edilmektedir. Yap\u0131lan bu hesaplamada i\u015f\u00e7iye d\u00fczenli \u00f6denen t\u00fcm \u00fccretlerin (yol paras\u0131, yemek paras\u0131, d\u00fczenli olmak ko\u015fuluyla ikramiye \u00f6demeleri vs.) br\u00fct tutar\u0131 g\u00f6z \u00f6n\u00fcnde bulundurulur.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>K\u0131saca K\u0131dem tazminat\u0131 ba\u015fka bir tabirle y\u0131pranma tazminat\u0131d\u0131r ve kendine \u00f6zg\u00fc hukuki niteli\u011fi vard\u0131r.
